Terms of Sales

Preamble

Websitewww.maisonelementaire.com(hereinafter "the Site") is published by the companyElementary House, a one-person simplified joint-stock company with capital of €10,000, whose registered office is located at 774 route de l'Isle sur Sorgue, 84250 Le Thor, and registered with the Avignon Trade and Companies Register under number 850 142 795 whose intra-community VAT number is FR25 850 142 795 (hereinafter "Elementary House").

Article 1: Applications of the General Conditions of Sale

The general conditions of sale (hereinafter the "GTC") detailed below apply exclusively to all orders for products and services placed via the Site (the "Products") withElementary Houseby any natural person visiting or making a purchase via the Site (hereinafter “the Customer”). Any order placed withElementary Housetherefore entails the Customer's unreserved acceptance of these conditions. These general conditions may be modified at any time and without notice byElementary House, the applicable conditions being those in force on the date of the order by the Customer. These general conditions of sale are permanently accessible at the following address:https://www.maisonelementaire.com/pages/cgvin a computer format allowing them to be printed and/or downloaded, so that the Customer can reproduce or save them.

Section 2: Products

A. General

The Products offered for sale byElementary Houseare those appearing on the Site on the day of its consultation by the Customer. Each Product will be the subject of a descriptive sheet which, in addition to the photograph, will contain: the price, the sizes or the dimensions and colors available, the composition, as well as any special characteristics. Minimal differences between a product and its photograph may exist, depending in particular on the resolution and color definition of the user's screen. Items such as, in particular, photographs, texts, graphics as well as all the information and characteristics illustrating and/or accompanying the Products are not contractual, which the Customer acknowledges.Elementary Housespecifies however that the majority of the Products follow artisanal manufacturing processes, which can lead to discolorations or slight deformations which cannot be considered as defects.

B. Availability

The Products are marketed within the limits of available stocks. In case of exhaustion of stocks,Elementary Housewill endeavor to indicate this clearly and to make it impossible to purchase the product concerned. Despite all the precautions taken byElementary House, if the products are unavailable,Elementary Housewill inform the Customer by e-mail as soon as possible. The Customer may then cancel his order and be reimbursed, where applicable, for the sums already paid. The permanent or temporary unavailability can in no way engage the responsibility ofElementary House, nor can it give rise to any right to compensation or damages in favor of the Client.

Article 3: Price

A. General

The price of the Products is mentioned in euros, all French taxes included (French VAT and other applicable taxes), excluding delivery costs which are notified to the Customer when he places an order. In the event of a change in the VAT rate, the price will be automatically changed without notice other than the due date of the new rate. For orders exempt from VAT, the provisions of the General Tax Code will apply.Elementary Housereserves the right to modify its prices at any time. The Products will be invoiced on the basis of the prices in force at the time of the validation of the order. In the event that an abnormally low price is indicated due to technical or human error,Elementary Housereserves the right to ask the Customer to complete the price already paid or to allow him to cancel his order by reimbursing him for all the sums already paid.

B. Promo Codes

Promotional codes only apply to non-discounted base prices. Promotional codes can be used once per Customer account unless otherwise instructed byElementary House. These codes are not refundable during an exchange.

Article 4: Order

A. Ordering

Order taking on the Site is subject to compliance with the procedure set up byElementary Housecomprising successive steps leading to the validation of the Order. The Customer can select as many Products as he wishes which will be added to the basket, the latter summarizing the Products chosen by the Customer as well as the prices and costs relating thereto (hereinafter the "Basket"). The Customer may freely modify the Basket before validating his Order. The validation of the Order constitutes confirmation of the acceptance by the Customer of the GCS, the Products purchased, their price as well as the associated costs.  

B. Order Confirmation

Upon acceptance of the Customer's payment, the Customer will receive an email confirming his order, summarizing all the items ordered, the billing and delivery address and the estimated delivery date. To this end, the Customer formally accepts the use of e-mail for confirmation byElementary Houseof the content of his Order. Invoices are available in the "my account" section of the Site.

C. Refusal to process an order

Elementary Housereserves the right not to validate the order in the event of: - abnormal or abusive complaints, - abnormal orders with regard to the quantities ordered, - abnormal or abusive exchanges and returns, - risk of non-payment, - existing dispute(s) (s) with the Client.Elementary Housereserves the right to ask its Customer for additional information if it deems it necessary, such as an identity document or proof of address. Without a response from the Customer within 5 days of the order, the order and the payment are cancelled.

D. Archiving of the order

The order confirmation is recorded in the registers ofElementary House, themselves stored on a reliable and durable medium.

 

Article 5: Delivery

A. General

Delivery means the transfer to the Customer of physical possession of the Products. Delivery will be deemed to have been made when the Customer or a third party designated by him, and other than the carrier proposed byElementary House, takes physical possession of the product. Any shipment of an order will be notified byElementary Houseto the Customer by sending an email allowing, if necessary, to follow the routing.

B. Delivery methods

Deliveries are provided by the services of Colissimo, Chronopost, UPS, Fedex and Mondial Relay from Monday to Friday, depending on the option chosen by the Customer when confirming his Order.

C. Delivery costs

Delivery costs are indicated in € including VAT and are the responsibility of the Customers. These costs may vary depending on the weight, volume, nature of the products as well as the carrier, the delivery method and the place of delivery. Delivery costs are notified to Customers when they place an order and are present in the “Delivery and returns” section of the Site.

D. Customs Fees

Outside the European Union, customs or import taxes may be added to the price of our products and remain the responsibility of the Customer. It is therefore the Customer's responsibility to inquire about their amount with their local customs office.

E. Delivery locations

Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the residential address of the Customer, of a natural person of his choice or of a legal person (delivery to his company ). Delivery cannot be made to hotels or to PO boxes.

F. Delivery times

Elementary Housedelivers the Orders within a maximum period of twelve (12) working days for a Delivery in Metropolitan France and twenty (20) working days for an international Delivery, this period being counted from the first working day after the validation of the Ordered. In order for these deadlines to be respected, the Customer must ensure that he has communicated exact and complete information concerning the Delivery address (such as, in particular: street number, building number, staircase number, access, names and/or intercom numbers, etc.).Elementary Housecan not be held responsible for the delay in delivery not being its fault or justified by a case of force majeure (as defined below). If the Delivery time is exceeded, the Customer may request the cancellation of the sale and obtain, within a maximum period of fifteen (15) days of his request to this effect, the reimbursement of the sums paid on the occasion of the Order. Notwithstanding the foregoing,Elementary Housecan not be held responsible for the harmful consequences resulting from a delay in delivery, only the reimbursement of the Product byElementary Housebeing possible by transfer to the bank account used for payment or by issuing a voucher.

G. Apparent anomaly upon delivery

Any apparent anomaly concerning an order (number of units, condition of the packaging, etc.) must be indicated precisely (detailed description of the anomaly) by the Customer on the carrier's delivery slip, in the presence of the latter. The Customer must immediately informElementary Houseby providing him with any useful evidence (photograph, description of the anomaly, etc.). An apparent anomaly means any anomaly that would normally be detected by a normally attentive and informed consumer. Otherwise, the products will be deemed to have been delivered free of any apparent anomaly. It is therefore up to the Customer to preserve his rights vis-à-vis the carrier under the conditions provided for in Article L.133-3 of the Commercial Code (motivated confirmation of the anomaly with the carrier by sending a registered letter within 3 days, excluding public holidays, following receipt of the affected products.).

Article 6: Payment

A. General

Full payment must be made when ordering. At no time can the sums paid be considered as a deposit or down payment. Payment for purchases is made either via Paypal or via the secure platform of our payment provider Stripe. For any information, the Customer can consult the official websites of Paypal (https://www.paypal.com) and Stripe (https://www.stripe.com/fr). For any transaction, the Customer will indicate the number appearing on the front of his card, the expiry date of his card and the cryptogram appearing on the back of his card (last three digits). The communication by the Customer of his credit card number constitutes authorization forElementary Houseto debit his account for the amount of his order. No cash on delivery will be accepted, whatever the reason. The data recorded and stored byElementary Houseconstitute proof of the Order and of all past sales. The data recorded by Paypal or Stripe constitutes proof of any financial transaction between the Customer andElementary House.  

B. Verification of payments

In order to protect against certain abusive practices on the part of fraudsters,Elementary Housechecks the orders that have been validated on its site. As part of this check, our customer service may be required to ask the Customer for certain documents useful for the validation of your order and in particular a proof of address in his name, or in the name of the person indicated for the delivery address, etc. . The request for authorization to debit the card is made at the time of validation of the order on the Site, except in the event of unavailability of the servers.Elementary Housereserves the right to proceed with a new request for direct debit authorization in the event that the first could not have succeeded due to the unavailability of the servers.

C. Secure payment - Protection of bank transactions

Elementary Houseentrusts the security of its transactions to Paypal and Stripe service providers. Banking data only circulates on the Internet in encrypted form, i.e. they are coded in such a way as to make them completely unreadable and are thus never kept byElementary House. Paypal and Stripe being technical service providers, they do not support disputes related to orders, which are handled directly byElementary House.

Article 7: Right of withdrawal - Refunds and returns

A. Deadlines and procedures for exercising the right of withdrawal

In accordance with article L.221-18 of the Consumer Code, the non-professional Customer has a period of fifteen (15) days from receipt of the Order to exercise his right of withdrawal fromElementary House, without having to justify its decision. The exercise of the right of withdrawal can be made by using and sending the model withdrawal form shown below, by post, to the following address:

In the case of an order relating to several goods delivered separately or to a good delivered in several lots or parts, this period expires on the day of taking possession of the last good / lot / part.

B. Verification of payments

The right of withdrawal cannot be exercised forthemcontracts listed in Articles L. 221-2 and L. 221-28 of the Consumer Code, in particular:

- Supply of goods made to the consumer's specifications or clearly personalized;

-   For the supply of a newspaper, periodical or magazine, except for subscription contracts to these publications. All well returned toElementary Housein contradiction with article L.121-28 of the Consumer Code will be returned to the Customer at the expense ofElementary Housewithout the Customer being able to demand any compensation whatsoever.

C. Terms of return of the Order under the right of withdrawal

The Customer returns the Order with the prepaid return form provided byElementary House, without undue delay and, at the latest, within fifteen (15) days following the communication of its decision to withdraw in accordance with Article L. 221-21 of the Consumer Code. Beyond this period of fifteen (15) days, the sale is firm and definitive. The Product must be returned in its original packaging and in its original condition allowing its remarketing accompanied by the purchase invoice. Any product damaged by the consumer will not be taken back. To make a return, the Customer must follow the procedure indicated on the return form received with his Order. The return of the Products is supported byElementary Houseif the place of Delivery is in France When the order was accompanied by a gift offered to the Customer under conditions – for example, gift offered only if a minimum order amount was reached – and the Customer no longer meets the necessary conditions upon obtaining the gift due to the exercise of the right of withdrawal by the Customer, the gift must be returned to Maison Elementaire with the returned products andElementary Housemay defer reimbursement until receipt of the gift or until the Customer has provided proof of shipment of the gift, the date used being that of the first of these events.

D. Reimbursement of Products returned under the right of withdrawal

Reimbursement of the Order byElementary Housetakes place no later than fifteen (15) days from the date on which it is informed of the Customer's decision to withdraw. However, the reimbursement takes place provided that Maison Elementaire has been able to recover the Products subject to the return and the request for reimbursement.Elementary Housemay defer reimbursement until receipt and verification of the products.Elementary Housemakes the refund using the same means of payment as that which will have been used for the payment of the Order. If and only if the latter has expired,Elementary Housewill approach the Customer in order to make the refund by another means of payment and insofar as the refund does not incur additional costs forElementary House. Reimbursement of an order paid for with an e-gift card, a gift card or a credit note will be automatically refunded as a credit note. If the Customer fails to comply with these T&Cs, Maison Elementaire will not be able to reimburse the Products concerned. The Customer's liability is only engaged with regard to the depreciation of the goods resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of the Product.

Article 8: Intellectual property

All the elements present on the Site, whether visual, textual or sound, are the exclusive property ofElementary House, or the holder of the intellectual property rights concerned, and are therefore protected by the intellectual property code and copyright. As such, any reproduction of the brandElementary Houseor the Site, in whole or in part, is strictly prohibited.

Article 9: Guarantees and liability

Elementary Houseshall not be liable to third parties for consequential damages, special damages or incidents resulting from negligence, failure or clumsiness of the Customer, or resulting from improper use by the Customer of one of the products offered for sale on the Site. Regarding access to the Site, consultation of the latter, the process of ordering, payment, delivery and service,Elementary Houseonly has an obligation of means. The responsibility ofElementary Housecannot be held liable for any inconvenience or damage inherent to the Internet network, in particular any disruption of the connection or any intrusion of a computer virus. In additionElemental Housee is exempt from any liability for any event qualified as force majeure within the meaning of the case law of the Court of Cassation. Finally the responsibility ofElementary Houseis limited to the amount of the Customer's order.

 

Article 10: Comments, suggestions and other user proposals

If, at our request, you submit specific content (for example, to participate in competitions), or if without our request, you send creative ideas, suggestions, proposals, plans or other elements, whether online, by e-mail, by mail, or otherwise (collectively, "Comments"), you grant us the right, at all times, and without restriction, to edit, copy, publish, distribute , to translate and otherwise use in any media any comments you send to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation to anyone for any comments provided; (3) respond to comments. We may, but have no obligation to, monitor, edit or remove content that we determine, in our sole discretion, to be unlawful, offensive, threatening, abusive, libelous, defamatory, pornographic, obscene or otherwise objectionable, or that violates any intellectual property or these General Conditions of Sale. You agree to write comments that do not violate the rights of third parties, including copyright, registered trademarks, confidentiality, personality, or other personal or property rights. You also agree that your comments will not contain any unlawful, libelous, offensive or obscene material, nor will they contain any computer virus or other malware that could in any way affect the operation of the service. or any other related website. You may not use a false e-mail address, pretend to be someone you are not, or attempt to mislead us and/or third-parties as to the origin of any comments. You are fully responsible for all comments you post and their accuracy. We take no responsibility and disclaim all liability for any comments posted by you or any third party.

Article 11: Errors, inaccuracies and omissions

Occasionally there may be information on the Site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, products, delivery times and availability.Elementary Housereserves the right to correct any errors, inaccuracies, omissions, and to change or update information or cancel orders, if any information on the Site or on any other associated website is inaccurate, and this, at any time and without notice, including after the Customer has placed an order.Elementary Houseis not required to update, modify or clarify the information in the Site or on any other associated website, including but not limited to information on prices, except as required by law. No defined date of update or refresh in the Site or on any other associated website should be taken into account to conclude that the information in the Site or on any other associated website has been modified or updated.

Article 12: Third party link

Certain content, products and services available through our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are under no obligation to review or evaluate the content or accuracy of any such sites, and we do not warrant or assume any responsibility for any content, website, product, service or other material accessible on or from these third-party sites. We are not responsible for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transaction made in connection with these third-party websites. Please read the third party policies and practices carefully and make sure you understand them before engaging in any transaction. Complaints, claims, concerns, or questions regarding such third party products should be directed to such third parties.

Article 13: Legal guarantees

All products, tangible personal property, sold at a distance benefit from the legal guarantee of conformity and the legal guarantee against hidden defects under the conditions of articles L.217-4 and following of the Consumer Code and 1641 of the Civil Code as well as , if applicable, the manufacturer's contractual warranty included in the purchase price of the product.

When acting as a legal guarantee of conformity, Customers:

- benefit from a period of 2 years from the delivery of the property to act;

- can choose between repairing or replacing the good, subject to the cost conditions provided for in article L.217-9 of the Consumer Code;

- are exempted from providing proof of the existence of the lack of conformity of the good during the 24 months following the delivery of a new good and the 6 months following the delivery of a second-hand good.

In addition, it is also recalled that:

- The legal guarantee of conformity applies independently of any commercial guarantee granted;

- Customers can decide to implement the guarantee against hidden defects of the thing sold provided for in article 1641 of the Civil Code and can thus choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.

A. Legal guarantee of conformity (content)

Article L.217-4 of the Consumer Code: The seller delivers goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when this has been charged to him by the contract or has been carried out under his responsibility.

Article L.217-5 of the Consumer Code: The property complies with the contract:

1° If it is specific to the use usually expected of a similar item and, where applicable:

- if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model;

- if it has the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labeling.  

2° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and which the latter has accepted.

Article L.217-9 of the Consumer Code: In the event of a lack of conformity, the buyer chooses between the repair and the replacement of the good. However, the seller may not proceed according to the choice of the buyer if this choice entails a manifestly disproportionate cost with regard to the other method, taking into account the value of the good or the importance of the defect. He is then required to proceed, unless this is impossible, according to the method not chosen by the buyer.

Article L.217-10 of the Consumer Code: If the repair and replacement of the good is impossible, the buyer can return the good and have the price refunded or keep the good and have part of the price refunded. The same option is open to him:

1° If the solution requested, proposed or agreed pursuant to Article L. 217-9 cannot be implemented within one month following the buyer's complaint;

2° Or if this solution cannot be without major inconvenience for him given the nature of the property and the use he is looking for. However, the resolution of the sale cannot be pronounced if the lack of conformity is minor.

Article L.217-12 of the Consumer Code: The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods. »

B. Warranty against hidden defects of the thing sold (content)

Article 1641 of the Civil Code: The seller is bound by the guarantee on account of the hidden defects of the thing sold which render it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have not acquired, or would have given only a lesser price, if he had known them. Article 1642 of the Civil Code: The seller is not liable for apparent defects of which the buyer has been able to convince himself. Article 1644 of the Civil Code: In the case of articles 1641 and 1643, the buyer has the choice of returning the item and having the price refunded, or keeping the item and getting part of the price refunded. Article 1646 of the Civil Code: If the seller is unaware of the defects of the thing, he will only be required to refund the price, and to reimburse the purchaser for the costs incurred by the sale. Article 1648 paragraph 1 of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.

C. Procedures for exercising guarantees

In case of non-conformity or hidden defect of the product, the Customer is required to address his complaint to the customer service ofElementary House. In case of return of a product, the Customer is invited to follow the procedure described in article 7. A. The exercise of these guarantees takes place at no cost to the Customer, in accordance with article L.217- 11 of the Consumer Code, on the condition, however, that the latter is entitled to request the benefit of these guarantees.

WARNING :Customers are informed that:

- They may be required to provide proof of the non-conformity of the product concerned when its nature or the lack of conformity invoked so requires,

-Elementary Houseregularly carries out tests relating to the conformity of the products sold and the proofs of conformity of the analyzed batches, which are kept within the premises ofElementary House, may, where appropriate, be opposed to Customers. AssumingElementary Housefinds an abusive or bad faith use of the legal guarantee of conformity or hidden defects (abnormally high frequency of use, returned product not corresponding to the purchased product, product returned late and in a manifestly depreciated state, non-conformity of a product that is clearly the result of inappropriate use by the Customer, etc.),Elementary Housereserves the right to give notice to the Customer to present, within eight (8) days, his observations on the alleged grievance. In the absence of a response or in the absence of a satisfactory response, Maison Elementaire reserves the right to invoice the Customer for compensation proportional to the management costs made necessary to process an abusive or bad faith request.

Article 14: Force majeure

In the event of the occurrence of an event of force majeure,Elementary Houseinform the Customer within fifteen (15) days of the occurrence of this event, by registered letter with acknowledgment of receipt. Expressly, are considered as cases of force majeure or fortuitous event, in addition to those usually retained by the jurisprudence of French courts and tribunals, total or partial strikes, lockouts, riots, boycotts or other actions of an industrial nature or disputes business, civil disturbance, insurrection, war, bad weather, epidemic, blockage of means of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal modifications or regulatory forms of marketing, computer failure, blocking of telecommunications, including wired or wireless telecommunications networks, and any other case beyond the control of the parties preventing the normal execution of the contractual relationship. All of the parties' obligations will be suspended for the duration of the force majeure event, without compensation. If the force majeure event continues for more than three (3) months, the transaction concerned may be terminated at the request ofElementary Houseor the Customer without compensation on either side. Failure to pay by the Customer cannot be justified by a case of force majeure.

Article 15: Declaration relating to protection
personal data

A. Legal guarantee of conformity (content)

In order to meet the needs of its Customers and to ensure an optimal remote service,Elementary Houseand the Site are required to collect personal data: surname, first name, title, email address, date of birth, postal address and delivery address, telephone number. The personal data collected byElementary Houseare processed for the exclusive purposes of managing the Customer relationship.Elementary Housecertifies the confidentiality of the personal data collected. In accordance with the provisions of the Data Protection Act No. 78-17 of January 6, 1978 as amended by Law No. 2004-801 of August 6, 2004, the processing of information collected byElementary Househas been the subject of a declaration to the National Commission for Computing and Liberties (CNIL) (n°1786387v0). In accordance with the retention principle of the General Data Protection Regulations, and with simplified standard 48 for the management of customer and prospect files, personal data relating to customers cannot be kept beyond the retention period strictly necessary for the management of the commercial relationship.Elementary Houseundertakes to delete or archive Customer data at the end of a period of 3 years following the last purchase. The Customer has a right to access and rectify the data concerning him, and can also assert his right to erasure or right to be forgotten, as well as his right of opposition or right to portability. To exercise this right, the Customer must send an email to the following address:contact@maisonelementaire.com.

B. General Data Collection and Use

has. Order: During your order, we are required to record your data in order to process your order as well as possible and to ship the products purchased. This information is also kept for security purposes, in order to comply with legal and regulatory obligations, as well as to enable us to improve and personalize our offers. Thanks to your e-mail address we will be able to send you an order confirmation and communicate with you if necessary. b. Login to your user accountur: When you place an order on the Site, we offer you access to your "User Account" protected by a password. This allows you to have access to information relating to your past orders and to correct your personal information if necessary. It is important not to disclose to third parties the access data to your "User Account", the use of which is strictly personal.

vs. Advertising: We use data about you to send you information about our Products and recommend Products for sale on our Site that may be of interest to you. We use email advertising only within the limits defined by law.

d. Subscription to the newsletter: If you decide to subscribe to our newsletter, you will receive information on advantageous offers which you can stop receiving at any time by clicking on the link provided for this purpose on each of the newsletters. The information collected as part of the registration to our newsletter allows us to make you more relevant commercial offers.

e. Consultation of websites: For security reasons, during your visits to our Site, the following data may be collected and stored temporarily: domain name or IP address, http response code, the number of bytes transferred, the address of the website through which the user arrived. This data is collected completely anonymously (we collect the data but we do not associate it with an identity) and allow us to provide more relevant offers to our users.

C. Privacy
